BuilderPress.com (“Builder Press” or the “BuilderPress Community” or the “Site”) is operated by BuilderPress LLC. (“BuilderPress” or “we”). The Site is a place where new home professionals can network with their peers, discuss home building topics and promote their commercial interests. The Site is also a public forum, where consumers can view information regarding new home building products and services.
By accessing or viewing the Site or using any blogging, networking, advertising or any other products or services provided by BuilderPress, you agree to be bound by these Terms of Use and the Community Guidelines. BuilderPress may, in its sole discretion, modify or revise these Terms of Use and the Community Guidelines at any time, and you agree to be bound by such modifications and revisions. It is your responsibility to stay apprised of any changes in these Terms of Use and the Community Guidelines. If you do not abide by these Terms of Use, you may not use the BuilderPress Community.
Using the BuilderPress Community
The Site and any BuilderPress products and services are available only to people who are of legal age to form a binding contract. You agree to use the Site for personal and commercial uses that are entirely and exclusively your own responsibility, and you agree that you in no way represent yourself as acting on behalf of BuilderPress.
Among other things, you agree not to:
- Modify, copy, reproduce, display, perform, sub-license, publish, create derivative works of, reverse engineer, use on any other website or sell any content other than “your Content” – provided by or obtained from the Site.
- Damage the Site or obstruct any other person’s use of the Site.

The BuilderPress.com Community is a Forum
The Site and certain BuilderPress products and services are operated and provided as a forum to connect members of the BuilderPress Community and to enable the exchange of information. We do not provide any appraisal, brokerage, listing, mortgage, title insurance, escrow or other real estate industry-related services, and we do not claim to be licensed to provide any real estate industry-related services. We do not sponsor, endorse, recommend or approve of any home builder, or other real estate industry-related service provider who offers services through the Site.
Because forums by their nature are open and collaborative, BuilderPress cannot make any assurance as to the timeliness or accuracy of information provided by the Site or any user. If any posting presents incomplete, insufficient or inaccurate information, BuilderPress cannot be held accountable. You must use your independent judgment to assess the quality of any individual, entity or information that you find on or through the Site. BuilderPress does not endorse, support, represent or guarantee the truthfulness, accuracy or reliability of any communications posted on the Site or endorse any opinion expressed on the Site. You acknowledge that any reliance on material posted on the Site will be at your own risk.
Much to the delight of our members, commercial transactions may result from the use of the Site. Other relationships, professional and otherwise, also may result. The outcomes of any such transactions or relationships are the responsibilities of the participating individuals alone, not of BuilderPress.com.

The BuilderPress Community encourages networking and the exchange of ideas. In furtherance of this aim, you may create links to the Site from any personal or third-party website, consistent with the Community Guidelines.

Be sure to familiarize yourself with the terms of use for those other linked and third-party sites and materials before using their services. BuilderPress may have no control over such linked and third-party sites, and you acknowledge and agree that BuilderPress is not responsible for the availability of such sites and does not endorse and is not responsible or liable for any content, advertising, products or other materials on such sites.
Your BuilderPress Account
In order to have complete access to the Site, and to get the most out of the BuilderPress Community, you will need to create an account. This account in effect represents your identity as you interact with other members of the BuilderPress Community. Therefore, it is crucial that you:
- Never use another member’s account.
- Provide accurate and complete information when establishing your account.
- Keep your account password secure.
- Notify BuilderPress immediately of any breach of security or unauthorized use of your account.
Also, please note that BuilderPress will not be liable for any losses or damages caused by unauthorized use of your account. Furthermore, you may be liable for the losses of the BuilderPress Community or others due to such unauthorized use. Although we have confidence in our security policies, their effectiveness relies upon your adherence to these Terms of Use.
BuilderPress reserves the right, in its sole discretion, to terminate or suspend your account if BuilderPress.com believes, or has been notified by a third party of its belief that, you may be infringing the rights of others, violating the copyrights of others or engaging in any inappropriate behavior. We also reserve the right, in our sole discretion, to terminate your access to all or part of the BuilderPress Community for any reason or no reason, with or without notice. In the event of termination, your account will be disabled and you will not have access to your account. We generally return your Content to you after your account is terminated. However, you should be aware that, in some circumstances, we may not be able to return your Content to you and that you may not otherwise have access to your Content, although residual copies of such information may remain in our system for back-up purposes.
Content You Contribute
As noted above, the Site is operated and provided as a forum. As a member, you may submit or post content to the Site, which might include text, messages, comments, ideas, suggestions, images, photos, illustrations, designs, icons, video clips, sounds, files, trademarks, trade dress, specifications, catalogs, literature, lists, technical information or other materials (collectively, “Content”). Content that you upload to the Site or submit for the use of the BuilderPress Community (“your Content”) is governed by these Terms of Use and the Community Guidelines. You agree that BuilderPress has no responsibility or liability for the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Site. BuilderPress retains the right to create limits on use and storage at its sole discretion and at any time, with or without notice.
You promise that your Content is Content that you deem to be beneficial to the BuilderPress Community and that your Content will be maintained at all times in accordance with these Terms of Use and the Community Guidelines.
You agree that you are solely responsible for all Content that you make available on the Site. You also represent and warrant to BuilderPress that you own all rights and have unlimited control of your Content, which makes it possible and legal for you to share and transmit your Content. Without limiting the generality of the foregoing, you agree that you will not post Content to the Site that is copyrighted by someone other than you, without the express, written permission of the copyright holder. You agree that your Content, once posted on the Site, is non-confidential.
Although you retain any ownership rights that you may have in and to your Content, once you post your Content to the Site, you hereby grant to BuilderPress.com, its affiliates and their respective successors and assigns a perpetual, worldwide, non-exclusive, sub-licensable (through multiple tiers) right and license, but not the obligation, to post, use, copy, publish, publicly display, exhibit, promote, transmit, frame, package, repackage and syndicate your Content, or any portion thereof, and to publish your name in connection with your Content and each of the foregoing activities, in all languages, via the BuilderPress Community, all distribution channels promoted by BuilderPress.com through the Site, and all partnerships and/or other channels that BuilderPress may from time to time take part in, promote or sponsor. You represent and warrant that you have all the rights, power and authority necessary to grant the foregoing license. You further agree that you will not make any claims against BuilderPress based on any allegations that any activities or alleged omissions within the BuilderPress Community, whether or not by or condoned by BuilderPress, infringe intellectual property rights associated with your Content. BuilderPress.com claims no ownership over any Content submitted, posted or displayed by you or any other user on or through the Site, and BuilderPress reserves the right to refuse to accept, post, display or transmit any Content in BuilderPress’s sole discretion.
Prohibited Activities
The following is a list of the kinds of activities that are strictly prohibited on the Site: (a) submitting Content that is offensive to the BuilderPress community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; (b) engaging in activities or submitting Content that could be harmful to minors; (c) engaging in activity or submitting Content that harasses or advocates harassment of another person; (d) engaging in activity that involves the transmission of “junk mail,” unsolicited mass mailing, “spam,” harvesting or otherwise collecting personally identifiable information about Site users, including names, phone numbers, addresses and email addresses without consent; (e) engaging in activity or submitting Content or promoting information that is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; (f) submitting Content that contains restricted or password only access pages or hidden pages or images; (g) submitting Content that displays pornographic or sexually explicit material of any kind; (h) submitting Content that provides instructional information about illegal activities; (i) submitting Content that contains viruses, Trojan horses, worms or any other similar forms of malware; (j) engaging in activities or submitting Content that solicits passwords or personally identifiable information for unlawful purposes from other users; (k) engaging in unauthorized commercial activities or sales without BuilderPress’s prior written consent, such as advertising, solicitations, contests, sweepstakes, barter and pyramid schemes; (l) using any device, software or routine to interfere or attempt to interfere with the proper working of the Site; (m) decompiling, reverse engineering or disassembling the Site or attempting to do so; and (n) taking any action that imposes an unreasonable or disproportionately large load on the Site or BuilderPress’s hardware and software infrastructure or that of any of its licensors or suppliers.
Syndicating Submissions Outside the BuilderPress Community
In addition to BuilderPress.com’s goal to connect home building professionals with one another, BuilderPress seeks to connect real estate professionals with the general public. In this regard, BuilderPress.com’s connections to other media, outside the Site, may provide you with opportunities to make yourself, your business and your Content visible to other audiences. For example, if you are employed by, a franchisee of, or affiliated with a national or regional real estate brokerage firm with which BuilderPress collaborates, your Content may be made available to a site or sites affiliated with that brokerage firm. For another example, if you are designated as a participant in a group blog, the Content you contribute may be made available through channels associated with the group blog program, or otherwise designated by the group blog member who is identified as the administrator for that group blog. In other instances, BuilderPress may ask you if you would like to syndicate submissions in or through additional channels, in which case BuilderPress will be permitted, but not be obligated, to syndicate your Content to additional third parties that you identify on the settings within your account profile. In all cases, syndication of your Content, if any, will be done pursuant to the license you granted to BuilderPress in the “Content You Contribute” section of these Terms of Use and will be done without compensation to you. In the event that you terminate your choice to syndicate your Content or your account is terminated for any reason, BuilderPress will take commercially reasonable steps to remove your Content from the BuilderPress Community; however, BuilderPress.com will not take any steps to remove your Content from any third-party sites or systems to which your Content was syndicated, and the license that you granted to BuilderPress will continue to support the perpetual use of your Content on such third-party sites or systems.
Content Contained in the Site
All content on the Site, other than your Content and other user-supplied Content, remains the exclusive property of BuilderPress.com (the “BuilderPress Content”). You acknowledge that BuilderPress owns all right, title and interest in and to the Site and the BuilderPress Content, including all intellectual property rights. You agree that you will not copy, reproduce, alter, modify or create derivative works from the Site or the BuilderPress Content. You also agree that you will not use any robot, spider, other automated device or manual process to monitor or copy any Content from the Site or any BuilderPress Content.
BuilderPress’ Advertisements
The Site and any BuilderPress products and services may be supported by advertising revenue and may display advertisements and promotions. As consideration for your use of the Site and any BuilderPress products and services, you agree that BuilderPress may place such advertising and that BuilderPress shall not be liable for any loss or damage of any kind incurred by you as a result of the presence of such advertisements or your subsequent dealings with advertisers.
Your Advertisements
You are responsible for adhering to all laws, rules, regulations and guidelines, and BuilderPress.com reserves the right to accept or reject any advertisement or require the elimination or revision of any of your advertising content. In addition to restrictions imposed by any applicable law, rule, regulation or guideline, BuilderPress imposes the following guidelines: (1) advertisements may not, directly or by implication, be vulgar, obscene, profane, pornographic, threatening, hateful or contain nudity; (2) beer, wine, hard liquor or distilled spirits (including products containing components thereof) may not be advertised on the Site; (3) advertising claims must be substantiated (prior to running the advertisements) with valid and reliable research or support; (4) advertisements comparing products or services may not distort or exaggerate differences or otherwise create a false, deceptive or misleading impression; (5) contests or sweepstakes may not be advertised on the Site; (6) firearms, ammunition, cigarettes, cigars, pipe tobacco, tobacco paraphernalia and smokeless tobacco may not be advertised on the Site; (7) advertisements may not make claims or representations that are false or that tend to deceive, mislead or misrepresent.
Advertising standards and practices may vary from region to region and, as such, it is your sole responsibility to ensure that any advertisement that you submit to the BuilderPress Community conforms to all applicable laws, rules, regulations and guidelines. The display of any advertisement on the Site does not constitute BuilderPress.com’s approval of that advertisement or its content.
Payment for Services
If you register for an BuilderPress product or service that requires the payment of fees by you, such fees will be paid by you by credit card upon your registration for such product or service and at regular monthly intervals thereafter, as applicable. If you do not pay for a product or service as required, BuilderPress may suspend such product or service, and such product or service may be made available to another person. You may terminate any BuilderPress product or service, and you will not be charged for such product or service beginning with the next calendar month following the date you provide BuilderPress with notice of your termination through your account profile. If your credit card expires or otherwise declines payment, your products or services may be suspended and made available to another person. In order for BuilderPress to process payments, you must provide BuilderPress with your complete billing address, telephone number and credit card or paypal information. BuilderPress accepts major paypal, credit cards, including Visa, MasterCard and American Express.
You are welcome to contact BuilderPress customer relations by email at support@BuilderPress.com concerning any charges or questions regarding the product or service that you purchased. If you dispute any charges, you must notify BuilderPress in writing within 30 days from the date of the charge; failure to notify BuilderPress within this time will result in the waiver by you of any claim relating to any such disputed charge.
Additional Products and Services
From time to time, BuilderPress may develop additional products and services and may make such products and services available to you through the Site. Any additional products and services will be subject to these Terms of Use and any other terms made available in connection with such products and services. In the event of any inconsistency between these Terms of Use and any other terms made available in connection with the additional products and services, these Terms of Use shall control.
License to Use the BuilderPress Community
BuilderPress.com grants to you a non-transferable, non-exclusive, limited and revocable license to access and use the Site and the BuilderPress Content for their intended purposes, in accordance with these Terms of Use and the Community Guidelines. You are strictly prohibited from making any unauthorized use of the Site and the Content found on the Site, unless you have obtained explicit written consent from either BuilderPress or, in the case of Content subject to copyright protection, the copyright holder of such Content.
The Content in the BuilderPress Community is provided on an “AS IS, AS AVAILABLE” basis. You agree that you will not hold BuilderPress.com liable for any Content or for any loss or damage incurred as a result of your use of any Content on the Site. Your use of the Site and the Content is at your own risk.
License to Use BuilderPress Sub-domains
As long as you comply with these Terms of Use and the Community Guidelines, BuilderPress grants to you a non-transferable, non-exclusive, limited and revocable license to use the sub-domain that BuilderPress assigns to you. BuilderPress reserves the right in its sole discretion to terminate or modify such license and to take action against any use that does not conform to these Terms of Use or the Community Guidelines. Except as set forth above, nothing in these Terms of Use grants or should be deemed to grant to you any right, title or interest in or to any sub-domain. Your use of any BuilderPress.com sub-domain will inure to the benefit of BuilderPress.
License to Use BuilderPress Trademarks
As long as you comply with these Terms of Use, the Community Guidelines and the guidelines regarding BuilderPress trademark usage described below and are otherwise a member of the BuilderPress Community in good standing, BuilderPress grants to you a non-transferable, non-exclusive, limited and revocable license to use certain designated BuilderPress trademarks (the “Designated BuilderPress Trademarks”), but only in connection with your use of the Site and any BuilderPress products and services, including your use of (a) an BuilderPress.com blog located at the sub-domain that may be licensed to you pursuant to these Terms of Use, and (b) one or more outside websites controlled by you that promote your BuilderPress blog. Any use of a Designated BuilderPress Trademark must be accompanied by a notice that clearly indicates that such BuilderPress trademark is owned by BuilderPress. BuilderPress reserves the right, in its sole discretion, to terminate or modify your permission to use any Designated BuilderPress Trademark and to take action against any use that does not conform to these Terms of Use or the Community Guidelines, infringes any BuilderPress intellectual property or other right, violates applicable law or otherwise damages the goodwill associated with BuilderPress’s trademarks.
Except as set forth above, nothing in these Terms of Use grants or should be deemed to grant to you any right, title or interest in or to any Designated BuilderPress Trademark or to any other BuilderPress trademark. Your licensed use of any Designated BuilderPress Trademark will inure to the benefit of BuilderPress. You agree not to challenge or assist others to challenge any BuilderPress trademark (except to the extent such restriction is prohibited by applicable law). The foregoing limited trademark license is provided “AS IS,” and BuilderPress disclaims any warranties either expressed or implied by law regarding the Designated BuilderPress Trademarks, including warranties of non-infringement. Furthermore, because you are not being charged for use of the Designated BuilderPress Trademarks, in no event will BuilderPress be liable to you for the subject matter of these Terms of Use under any theory of liability, including for any direct, indirect, incidental, special, consequential, punitive, exemplary or other damages arising out of these Terms of Use or your use of the Designated BuilderPress Trademarks.
In order to maintain the foregoing limited trademark license, you agree to comply with the following guidelines:
- Except as provided below, you may not alter or modify a BuilderPress trademark in any way.
- You may not display a BuilderPress trademark as the most prominent element on any website, other than the sub-domain that may be licensed to you pursuant to these Terms of Use.
- You may not display a BuilderPress trademark in any manner that implies that your relationship with BuilderPress is any thing other than as a member of the BuilderPress Community in good standing.
- You may not display a BuilderPress trademark on any website that contains or displays adult content, promotes gambling, involves the sale of tobacco or alcohol or violates any law.
- You may not display a BuilderPress trademark in a manner that is, in BuilderPress’s sole opinion, misleading, unfair, defamatory, infringing, libelous, disparaging, obscene or otherwise objectionable to BuilderPress.
- You may not incorporate any BuilderPress trademark features into your own product names, service names, trademarks, logos or company names; adopt any marks, logos, slogans or designs that are confusingly similar to an BuilderPress trademark; or register or attempt to register any domain names, trademarks, trade names or other distinctive brand features that are confusingly similar to a BuilderPress trademark.
In addition, from time to time, BuilderPress in its sole discretion may grant a licensed user permission to create certain derivatives of the Designated BuilderPress Trademarks. Current permissible derivatives are described and may be viewed via this link. Any and all such derivatives shall be subject to the terms and conditions of the license granted with respect to the Designated BuilderPress Trademarks, and your licensed use of such derivatives will inure to the benefit of BuilderPress.com.
Notice to Copyright Holders
We are committed to upholding the rights of copyright holders. If you are a copyright holder, or an agent of a copyright holder, and you believe that a BuilderPress member posting, user submission or other Content infringes upon your copyright, please submit a notification to us. You may do so pursuant to the Digital Millennium Copyright Act, by providing the following information to our copyright agent:
- A physical or electronic signature of a copyright owner or an authorized agent of anyone who holds proprietary rights to the material that has been infringed.
- Specific identification of the material claimed to have been infringed.
- Specific identification of the material that is claimed to be infringing.
- A statement that you believe the use of material in the way that you have deemed unlawful, is not authorized by the copyright owner or its agent.
- A statement that the information in the notification is accurate and that you are authorized to act on behalf of the owner of an exclusive right, under penalty of perjury.
- Contact information, such as an address, telephone number and an electronic mail, so that BuilderPress can contact you.

Privacy
As a condition to using the Site, you agree to the terms of BuilderPress.com’s Privacy Policy, which may be updated from time to time. You agree that BuilderPress may access or disclose your personal information, including the content of your communications, if it is required to do so in order to comply with any legal process or governmental request, or as otherwise provided in BuilderPress.com’s Privacy Policy or these Terms of Use.
Disclaimer of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
1. YOUR USE OF THE SITE IS AT YOUR SOLE RISK. THE SITE IS PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BuilderPress EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
2. BuilderPress DOES NOT WARRANT THAT (A) THE SITE WILL MEET YOUR REQUIREMENTS, (B) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, RELIABLE OR ERROR-FREE, (C) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTIONS, OR (D) ANY ERRORS IN THE SITE WILL BE CORRECTED.

Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT BuilderPress SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF BuilderPress HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM: (1) THE USE OR INABILITY TO USE THE SITE; (2) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SITE; (3) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (4) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE; OR (5) ANY OTHER MATTER RELATING TO THE SITE.
Indemnification
You agree to indemnify and hold BuilderPress and its subsidiaries, affiliates, shareholders, directors, officers, agents, employees and licensors harmless from any loss, liability, claim or demand, including reasonable attorney fees, made by any third party due to or arising out of your Content or any other Content you submit, post, transmit or otherwise make available through the BuilderPress Community; your use of the Site; your membership in the BuilderPress Community; your violation of these Terms of Use; your violation of the Community Guidelines; or your violation of any rights of another.
Statute of Limitations
You agree that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to your use of the Site or these Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.
Choice of Law; Jurisdiction; Forum
These Terms of Use will be governed by and construed in accordance with the laws of the State of Texas, without giving effect to its conflict of laws provisions or your actual state or country of residence. You agree that any claim, legal proceeding or litigation arising in connection with your use of the Site or any product or service obtained from us will be brought solely in Texas and you consent to the jurisdiction of the federal and state courts in Texas.
Miscellaneous Provisions
You may not assign your rights or delegate your obligations under these Terms of Use without the prior written consent of a duly authorized executive officer of BuilderPress. Unless expressly provided in these Terms of Use, these Terms of Use are not intended to benefit, nor shall they be deemed to give rise to, any rights in any third party. The waiver by BuilderPress of a breach of any provision hereof shall not be taken or held to be a waiver of the provision itself. If any provision of these Terms of Use is held by a court of competent jurisdiction to be contrary to law, such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law, and the remaining provisions of these Terms of Use shall remain in full force and effect.
